O ABUSO DE PODER NA CONDUÇÃO DO INQUÉRITO POLICIAL MILITAR

Resumo

O presente trabalho tem como escopo apresentar sucintas orientações aos encarregados de inquérito policial militar na justiça estadual de Mato Grosso, em especial os militares do Corpo de Bombeiros Militar de Mato Grosso, no objetivo de indicar normas de direito que possam auxiliá-los na condução do referido procedimento e concluí-los sem o cometimento de abuso de poder. Para tanto, foi realizada pesquisa bibliográfica na doutrina majoritária e trazido os elementos necessários para demonstrar como o responsável pela condução de inquérito policial militar, deve agir para evitar a prática de abuso de poder, discorrendo sobre a natureza do IPM, suas características e princípios, além de fazer a identificação da ocorrência da prática do abuso de poder e claro, dar o entendimento necessário para que o encarregado do IPM, requer para conduzir sua investigação de modo que este seja ilibado da existência de cometimento de abuso de poder. Dessa forma, verificou-se que há efetivamente uma corrente que acredita igualmente no modo como o responsável por conduzir um IPM deve se portar, visando evitar o abuso de poder, logo, a Revisão Bibliográfica de autores renomados trouxe o esclarecimento almejado.

ABSTRACT: The present work aims to provide guidance to those in charge of military police investigation in the state justice of Mato Grosso, especially the military of the Military Fire Brigade of Mato Grosso, in order to indicate legal rules that can assist them in conducting the aforementioned. procedure and conclude them without committing an abuse of power. To this end, a bibliographic research was carried out on the majority doctrine and brought the necessary elements to demonstrate how the person responsible for conducting a military police investigation should act to avoid the practice of abuse of power, discussing the nature of the IPM, its characteristics and principles, in addition to making the identification, the practice of abuse of power occurs and, of course, giving the necessary understanding so that the person in charge of the IPM, requires to conduct his investigation so that he is cleared of the existence of an abuse of power. Thus, it was found that there is actually a current that also believes in the way the person responsible for conducting an IPM should behave, in order to avoid the abuse of power, therefore, the Bibliographic Review of renowned authors brought the desired clarification.
